The Fire Precautions (Workplace) Regulations 1997 (amended 1999) requires any business with 5 or more employees to carry out a written risk assessment and have an emergency plan. Failure to undertake and hold a written risk assessment is a criminal offence. Additionally, other premises can be subject to different regulations that place differing special requirements, particularly if the public may be at risk. Examples include Hotels, licensed premises and restaurants, and areas used for public entertainment.

In most cases the precautions implemented following a risk assessment will result in the installation of (or an upgrade to) a fire alarm system. Regular review of a risk assessment will be required to ensure any changes within the business or building layout are still compliant with the Fire Precautions (Workplace) Regulations.

British Standard BS5839 regulations for the design, installation and maintenance of fire detection and alarm systems, details the specific requirements for detection and alarm equipment needed to satisfy the Fire Precautions regulations.

BS5839 regulations also require the duty holder to undertake periodic checks (Daily, weekly, quarterly and annual checks are all required, and should be recorded in the fire safety log book) to ensure the functionality of the system has not been compromised.

Failure to keep the fire alarm system in working order could lead the local fire brigade to serve enforcement notices requiring compliance, and they also have the authority to close any building which does not meet this act.

As regulations can change over time, it is your responsibility to ensure your procedures and systems are kept up to date. Failure to do so can result in your installation no longer complying, and thereby breaking the law.
